Kazemi's son can sue Iran Torture death. But estate can't launch suit: ruling
Stephan Hachemi is the son of Zahra Kazemi, who was beaten to death while in detention in Iran. He has fought for seven years for the right to sue Iran for its involvement in her death.

After nearly seven years of legal wrangling, Stephan Hashemi found out on Wednesday that he will be permitted to proceed with a civil suit filed against the Iranian government for its alleged involvement in his mother's torture and death.
The 32-year-old had been seeking the right to sue Iran, its supreme leader, Ayatollah Sayyid Ali Khamenei, and two officials for authorizing and committing the violent rape that led to Kazemi's death in July 2003. While this week's decision represented a partial victory for Hashemi, Superior Court Justice Robert Mongeon also ruled that Kazemi's estate would not be allowed to proceed with its own $17-million suit against the Middle Eastern nation.
"That was really disappointing," said Hashemi. "What was really motivating for me was that this case could serve as a precedent ... so other victims of torture might have legal recourse ... on the other hand, it was good to hear that the judge had left open the option for my (personal) case."
Iran had argued that under Canada's State Immunity Act, neither its government nor its officials could be the targets of civil litigation in Canada. In his ruling, Mongeon agreed that while the estate's litigation was indeed subject to the Act and could therefore be blocked, Hashemi's case was a rare exception and could move ahead because his trauma occurred on Canadian soil.
Back in March, the judge commented that ruling on legal immunity when torture is involved creates "a certain complexity" and Hashemi's lawyer, Kurt Johnson, agreed that the case is indeed breaking new ground in Canada.
"As far as we know, it's the first time that acts of torture that have been committed against Canadians on foreign soil could be scrutinized at a trial in Canada," said Johnson yesterday. "This is a major development."
Kazemi, a Canadian citizen, was arrested for taking photographs outside a Tehran jail during a student protest. She died in prison without a single charge being laid against her, and was buried in Iran without an autopsy. In 2005, an Iranian physician who fled the country revealed he had examined Kazemi after her arrest and found evidence that she had been brutally beaten and sexually assaulted.
The two sides have been given 30 days to appeal the judge's ruling, said Johnson, adding that "it's safe to say that both parties are looking at the possibility of appeal."
That could mean several more years in court for Hashemi, but he said it's all part of the journey he agreed to undertake following his mother's death.
"It's certainly tiring, but at the same time ... my mother gave me everything," he said. "She was everything I had. It's an honour to assume this responsibility. And I have a responsibility to others -Canadians and Iranians. This is a symbolic case, and could still have a great impact.

Ahmad Khatami is one of the ultra conservative who have always supported Ahmadinejad and his coup d' etat in last presidential election and called for the arrest , detention and killing of reformists Iranian moslems and the leaders of green movement during the whole last year of Iranian people uprising. Now he is talking about the "vacume of Islamic Leader" in Arab states.
He said: "He is worried about the vacume of Islamic leadership in Arab States" ! ? I think he is worried more about his own future and the future of his own regime of the Islamic Republic in Iran. He is worried and has nightmare day and night.
The People in Arab states must think twice when following or gathering and chanting under moslem organization banners which have ties with Islamic Republic in Iran. They must know that , Iranian people including moslem intellectuals are also trying to oust this regime and sooner or later it will happen.
Arab people must stay alert and follow democratic organization or people and at the end not to end up with a regime like Islamic Republic or Hizbullah in their countries.

Then what can people of the world call him or call a person who stayed in power for nearly 30 years!?
Mr. Obama is speaking double standard too. Instead of withdrawing his support for Hosni Mubarak using careful words which would at the end translated or understood as peacifism when it comes to Egypt and Egyptian people.

Iran: Deepening Crisis on Rights
Huge Spike in Executions; Lawyers Targeted for Championing Freedoms
(New York, January 26, 2011) – The Iranian government’s high rate of executions and targeting of rights defenders, particularly lawyers, in 2010 and early 2011 highlights a deepening of the human rights crisis that gripped the country following the disputed June 2009 presidential election, Human Rights Watch said in issuing its World Report 2011 Iran chapter. According to Iranian media reports, authorities have executed at least 73 prisoners – an average of almost three prisoners per day – since January 1, 2011.
The 649-page report, the organization’s 21st annual review of human rights practices around the globe, summarizes major human rights issues in more than 90 countries worldwide. In Iran, since November 2009 authorities have executed at least 13 people on the vague charge of moharebeh, or “enmity against God,” following flawed trials in revolutionary courts. The government also harassed, arrested, detained, and convicted several lawyers in 2010 for their work defending the rights of others. At the same time, scores of civil society activists have spoken out against the government crackdown despite facing harsh consequences.
“The noose has tightened, in some cases literally, around the necks of activists in Iran,” said Sarah Leah Whitson, Middle East director at Human Rights Watch. “The government’s crackdown has gone beyond silencing post-election demonstrators and is now a broad-based campaign to neutralize Iran’s vibrant civil society and consolidate power.”
The executions and mounting pressures against lawyers took place amid a broad crackdown following the election, and resulted in the killing of dozens of demonstrators by security forces and the detention of thousands of political opposition members and civil society activists. In early 2010 security forces announced that they had arrested more than 6,000 people in the months following the June 12, 2009 election. Those arrested included demonstrators, lawyers, rights defenders, journalists, students, and opposition leaders, some of whom remain in prison without charge. Iran’s revolutionary courts have issued harsh sentences, in some cases based on forced confessions, against dozens convicted of various national security-related crimes.

Tunisia upheaval casts shadow on Arab summit

CAIRO -- The head of the Arab League called Monday on rich Arab countries to extend a helping hand to their needy brothers as the turmoil in Tunisia cast a shadow over the Arab economic summit due to open in Egypt later this week.
The summit was meant to be a platform to discuss trade, business and investment, but officials say the Tunisian uprising - triggered by political repression, rising unemployment and skyrocketing food prices - will now top the conference's agenda.
In a speech to delegates in the Red Sea resort of Sharm el-Sheikh, League Secretary-General Amr Moussa urged rich Arab countries to help their poorer brothers.
"The less developed countries need help to build their economies and promote development," he said.
Moussa did not directly address the Tunisian crisis in his speech, but on Saturday he predicted that the unrest in the North African nation will have an impact on the rest of the Arab world.
Addressing a news conference Monday, Moussa said economic and political reform in the Arab world should go together. "Democracy and development should go hand in hand. Otherwise there will be no progress in the region. It is not sufficient to talk about economy alone," he said.
Tunisian Foreign Minister Kamal Merjan spoke for two hours in Sharm el-Sheikh to his Arab counterparts and assured them that the new government was in "full control" of the country, said a diplomat who was present for the meeting.
Merjan assured the Arab ministers that new elections would be held in the next 45 to 60 days and international monitors would be allowed to observe them, added the diplomat who spoke on condition of anonymity because he was not authorized to speak to the press.
Weeks of protests over corruption and political repression forced Tunisia's longtime president Zine El Abidine Ben Ali to flee the country Friday to Saudi Arabia.
Tunisian authorities were still struggling to restore order on Monday.
Hours before diplomats started their preparations for the summit, an Egyptian man set himself on fire in an apparent protest outside the parliament building in central Cairo. The incident appeared an attempt to copy the self-immolation and death last month of an unemployed 26-year-old Tunisian that triggered the protests leading to Ben Ali's overthrow.
Dozens of Egyptian activists have been waging daily protests in front of the Tunisian embassy in Cairo in solidarity with the Tunisians. Writing on Twitter, the Egyptian opposition leader and former head of the U.N. nuclear watchdog, Mohamed ElBaradei said: "Violence in Tunisia now is a product of decades of repression."
"(The) regime in Egypt must understand that peaceful change is only way out," he wrote.
Speaking at a news conference in Sharm el-Sheikh Monday, Egypt's Minister of Trade and Industry Rachid Mohamed Rachid urged Arab governments to address economic hardships faced by their people.
"Events in Tunisia underscore (the need) to jointly work to combat poverty and unemployment in Arab countries because part of the problems behind the events were economic," he said.
But Egyptian Foreign Minister Ahmed Aboul Gheit ruled out the possibility that Tunisia's political uprising will spread to other Arab countries, including Egypt.
"This is pure nonsense," he told reporters in Sharm el-Sheikh. "Those who are promoting fantasies and trying to ignite the situation will not achieve their goals and will only harm themselves," he warned.

Nasrin Sotoudeh, 45, who was jailed in September for talking to foreign media, was sentenced to 11 years in jail and banned for 20 years from working as an attorney and leaving the country, her husband told AFP.
"We are deeply concerned," Cannon said in a statement. "Such a sentence is completely unacceptable and unjustifiable."
"We once again urge the government of Iran to reverse the deterioration of human rights in its country," he added.
Sotoudeh, the mother of two, represented Nobel Laureate and lawyer Shirin Ebadi and her family as well as Issa Saharkhiz, a journalist and aide to opposition leader Mehdi Karroubi, and Heshmat Tabarzadi, a vocal secular democracy activist.
She was also the lawyer of Arash Rahmani-Pour, a 20-year-old man who was executed in January 2010 along with another man for membership in a monarchist group and for being a "mohareb," or an enemy of God.
Sotoudeh complained that she had been prevented from attending his trial and that she had learned about the execution after it was carried out.
The National Lawyers Guild expresses its support and solidarity with Iran’s human rights defenders who have been prosecuted and/or arrested due to their human rights activities. The National Lawyers Guild is especially concerned for the well being of Nasrin Sotoudeh, a colleague of Nobel Peace Prize Laureate, Shirin Ebadi, whose health is quickly deteriorating from three separate hunger strikes undertaken to protest her lack of due process.
The National Lawyers Guild also urges the release of human rights lawyer, Mohammad Oliyafar who suffers from leukemia and was sentenced to one year prison for publicizing the case of his clients. The National Lawyers Guild condemns the systematic persecution of the founders and members of the Defenders of Human Rights Center, including the nine-year prison sentence dealt to Mohammad Seifzadeh, co-founder of the DHRC, and Mohammad Ali Dadkhah and Abdolfattah Soltani for establishing DHRC.
We call upon the Islamic Republic of Iran to adhere to the standards set-forth by the UN Basic Principles on the Role of Lawyers, which states that lawyers must be allowed to carry out their work “without intimidation, hindrance, harassment or improper interference.” It also recognizes that lawyers are entitled to freedom of expression, including “the right to take part in public discussion of matters concerning the law, the administration of justice and the promotion and protection of human rights.”
As peers of Iran’s detained human rights defenders, the National Lawyers Guild urges that
1. The Islamic Republic of Iran to immediately and unconditionally release Nasrin Sotoudeh, all detained human rights defenders, and prisoners of conscience, and recognize that the world will hold the IRI accountable for the well-being of Nasrin Sotoudeh and all prisoners of conscience.
2. The UN High Commissioner for Human Rights, Navi Pillay publicly call on the Islamic Republic to unconditionally release Nasrin Sotoudeh and other human rights defenders.
3. The world’s governments and authorities work with their colleagues and appropriate bodies to ensure Nasrin Sotoudeh’s release and to call on Iran to end its persecution of human rights defenders.
The National Lawyers Guild hopes in the coming days, the appropriate steps will be taken to remedy the dire situation of human rights defenders in Iran.

These kinds of behaviour continued among special people with special talent in revenge- barbarity in the society who does not want to open their eyes and learn from history. These people dont know nothing about modernity, culture , change and human rights.
According to " Mohabat News" , the security and intelligent agents of the Islamic regime attacked on the homes of our Iranian -christian families and arrested more than 60 people.
The attack was organized on Christmas day ( Saturday December 25th). In their attack at Iranian -christian families home the agents searched the houses and took with them the personal belongings including books and computers and CD's of the innocent Iranian -Christian people who were just having celeberation for their New Year.
This is unacceptable.
These kinds of violent activities (Intimidation and fear tactics)towards non moslem and even Sunni moslems are a clear violation of human rights.

Although Iran is predominantely a religious country but the religion isn't the mental disturbance or apprehension of the Iranian people. Infact what the people of Iran are interested based on my opinion is to have a secular state and they showed this desire more than 100 years ago with the constitutional revolution by bringing onto trial and executing a high ranking clergy like Sheikh Fazlollah Noori who was against law,constitution and freedom.people watched his execution and i think this didn't happen in any other country .The reason for this is because although Iranian have tendency towards religion but they weren't fundamentalist .
So, the religion didn't overshadow the daily life of Iranian people, religion had its place and life had also its place. Iran is the first country in the world that experienced a fundamentalist islamic government and this happened by few fundamentalist with particular vision on religion.

In the future , the graduate alumni for the sake of Ahmad Zeidabadi, the students for the sake of Bahareh Hedayat -Majid Tavakoli, Behrouz Javid Tehrani , the workers for the sake of Osanlou , the lawyers for the sake of Nasrin Sotoudeh and the teachers for the sake of Abdolah Momeni will rise and fight back stronger than before.

CJFE reports that 87 journalists were killed worldwide in 2010
Three countries bore the brunt of the killings – Pakistan (14), Mexico (13) and Honduras (10) which accounts for 43% of journalists murdered in 2010. The governments of all three countries have failed utterly to protect the safety of journalists. The countries also share the parallel problem of impunity – killers of journalists are not being brought to justice.
The 87 journalists killed this year is a decrease from the 101 journalists killed in 2009, but that figure included the tragic massacre of 32 journalists on November 23 in the Philippines – the most journalists ever killed in one day.
“On the surface – the fact that 14 fewer journalists were killed this year than last year is good news,” says CJFE President Arnold Amber. “But quite obviously many journalists live with this constant threat just for doing their jobs.”
Although the image of a journalist being caught in the crossfire of conflict is a common one – the reality for most of the 87 journalists killed this year, as in other years, is that they were deliberately targeted. And many of them had reported receiving death threats because of the type of investigative stories they were covering in the weeks or months before their murders.
The ways in which journalists have been killed are various and paint a chilling picture of the dangers journalists face. Turkish journalist Metin Alataş appears to have been forced to commit suicide (April 4); Mexican journalist Marco Aurelio Martínez Tijerina was kidnapped on July 9 and found dead July 10 with at least one bullet to the head and signs of torture; Military officers in the Democratic Republic of Congo killed journalist Patient Chebeya Bankome at his home (April 5); and journalists Pervez Khan and Abdul Wahab were killed by a suicide bomber in Pakistan (December 6).
In one tragic and preventable case, Yemen journalist Mohammed Shu'i Al-Rabu'i, was killed on February 13, by four or five gunmen who had been arrested after attacking him a few months earlier but were released before charges were brought. Security Chief Abdelrazeq Az-Zareq said that he took "full responsibility" for their release at the end of 2009.
Many journalists are targeted either at their place of work or at their home – and there are many reports of police or military involvement. In Mexico, journalists are targeted by drug traffickers, police and members of the army. Mexican president Calderon’s move to intensify drug enforcement has seen increased violence and made reporting significantly more dangerous, causing many journalists to flee the country.
Also, of great concern is the new trend in Pakistan of suicide bombings of journalists. Six journalists died from bombings; the other eight were shot in various attacks. In a Dec. 6 suicide bombing in which journalists were killed, the journalists were covering an anti-terrorism strategy discussion at a council meeting in the northwest Pakistani border town of Ghalanai.
While local journalists continue to face the greatest danger in carrying out their work, 2010 did see several attacks and killings of foreign journalists working abroad. These included British journalist Rupert Hamer in Afghanistan; Tongalese journalist Stanislas Ocloo in Angola; Italian journalist Fabio Polenghi in Thailand; Turkish journalist Cevdet Kılıçlar in international waters near Israel; and American journalist James P. Hunter in Afghanistan.
Kidnappings of journalists, local and foreign continue to be a major problem especially in Mexico, Pakistan, Nigeria, Somalia and other nations. Canadian journalist Khadija Abdul Qahaar, also known as Beverly Giesbrecht, was abducted in Pakistan on Nov. 11, 2008. She remains missing but there were disturbing reports in November that she may have died; these reports have not been confirmed.
“In releasing this report, CJFE hopes to draw attention to the risks that journalists face around the world,” Amber stated. “Our organization is calling on Canadians and the international community to work together to protect the rights of journalists and to end the tragic culture of impunity which allows most murders of journalists to go unpunished.”
CJFE records the number of journalists that are killed or targeted in the line of duty because of their reporting or affiliation with a news organization. CJFE compiles its statistics from the reports of the more than 90 member groups that make up the International Freedom of Expression Exchange (IFEX). The IFEX Clearinghouse which gathers and disseminates information from the network is managed by CJFE and based in Toronto.
